Rental Terms & Conditions

General

These terms and conditions represent a legally binding contract between 'you' the holiday makers and 'us' the owners/manager and binds you & all the members of your party.

You must ensure that all members of your party accept and abide by the terms & conditions of the booking.

The property as referred to below is the property selected by you for the purpose of this booking.

The contract between you and the us will come into existence when we receive payment and issue a confirmation of booking.

The person making the booking is considered the lead guest and must be at least 21 years old.

You cannot allow more people to stay in the Property than expressly authorised, nor can you significantly change the makeup of the party during your stay in the Property.

A deposit of 25% of the holiday price is payable at the time of booking. This deposit is not refundable. Bookings made less than 4 weeks before your arrival date must be accompanied by the full payment and the £100 refundable security/damage deposit.

The balance and £100 security/damage deposit must be paid within 4 weeks of the holiday start date.

We (the owner) reserve the right to refuse any booking.

Cancellations

All cancellations must be immediately notified by email or in writing.

If your cancellation 4 weeks or more before the start date then your deposit will be forfeit. If your cancellation is less than 4 weeks before the start date then the full balance remains due and is not refundable.

We strongly advise that you take out comprehensive travel insurance. If you choose not to then you accept responsibility for any loss that you may incur due to your cancellation.

Your booking will not be cancelled by the owner except in exceptional circumstances. Notification will be given of the cancellation as soon as possible and we will promptly refund all payments made for your holiday.

Our liability for cancellation will be limited to payments made to us. No compensation or consequential losses shall be paid.

Arrival/Departure Times

You can arrive at the property any time from 16:00 on your arrival date and must depart by 10.30 on your departure date (unless otherwise agreed)

Your obligations

You agree to comply with the regulations set out in any property manual/guest information/house rules on our website & The Bay Filey's site rules and any other regulations reasonably specified by us.

You agree to keep and leave the Property and the furnishings and contents in good condition.

You agree not to cause any damage to any other part of the Property nor to do anything that may be reasonably considered to cause a nuisance or annoyance to others.

You agree to take all necessary steps to safeguard your personal property while at the Property.

You agree to ensure that each member of your party is covered by appropriate comprehensive travel insurance.

No parties are allowed in our properties.

Before departure guests must ensure that all windows are closed, bins are emptied, beds are stripped and linen placed in bags provided, dishes are cleaned and the property left as you found it.

No smoking is permitted anywhere on the premises.

All doors must be locked and windows closed whenever you leave your property unoccupied.

The client may in no circumstance re-let or sublet the property, even free of charge.

All inventory must remain in the property it was in at arrival and not be taken to another property.

Children under 18 must be supervised by their parents/guardians at all times.

In the event that you notice damage in your accommodation please let us know immediately so that we can take the appropriate action. If there have been any breakages during your stay, we would be grateful if you could advise us before you leave.

We reserve the right to terminate a holiday without compensation where the unreasonable behaviour of the persons named on the booking (or their guests) may impair the enjoyment, comfort or health of others.

You accept responsibility for any theft, breakage or damage caused by you or any member of your party and agree to indemnify us in full for any loss that we may incur as a result.

Dogs

Up to 2 well behaved dogs aged 2 or over are permitted, with prior approval. However, all dogs must be kept downstairs, off furniture and up to date with all vaccinations and flea/worm treatments.

Security/Damage deposit

The accommodation will be inspected at the end of the holiday and you may be charged for any loss or damage found.

The owner reserves the right to make a charge to cover additional cleaning costs if the client leaves the property in an unacceptable condition.

In the event that any keys issued are not returned at the end of your stay, then the cost of replacement will be charged to you.

The security deposit will be returned within 14 days of the end of your holiday less the cost of damage/breakages.

Limit of Liability

Your Booking is made as a consumer for the purpose of a holiday and you acknowledge that we will not be liable for any business losses howsoever suffered or incurred by you.

Whilst every care is taken to provide a true and accurate description of the property, over time, alterations are made and some things do change. The holidaymaker accepts that no refunds are available for such discrepancies.

The owner shall not be liable for any temporary defect or malfunction of any equipment, machinery or if any facilities at 'The Bay, Filey', become unavailable.

The internet connection is available (at no extra cost) subject to technical availability.

Complaints

Any problem or complaint which the client may have concerning their holiday must be immediately reported directly to us/our representatives and we will endeavour to put matters right.

Miscellaneous

We or our representative reserve the right to enter the property at any time to undertake essential maintenance, repairs or for inspection.
